2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 302 and 120B of the Indian Penal Code and sections 27 of the ArmsAct.

3. As per the prosecution case, petitioner instigated co-accused Rajeshwar Yadav who fired his gun on the son of the informant causing his death.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. At best, petitioner is order giver and there is no allegation of committing overt act against the petitioner.

5. Learned counsel for the State as well as the informant oppose the prayer for bail.

5. Considering the aforesaid facts of the case, prayer

Patna High Court CR. MISC. No.7616 of 2025(2) dt.01-05-2025 2/2 for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Bhojpur at Ara in Sahar Police Station Case No. 197 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
