Petitioner apprehends his arrest in a case registered for the offence punishable under Section 363, 366A/34 of the Indian Penal Code.

As per allegation in the FIR, daughter of the informant went to Durga Temple but did not return then a search was made by her family members. During search, informant came to know by villagers that his daughter was seen with petitioner and co-accused Gaurav Kumar going towards Dhamdaha by motorcycle.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case on the basis of suspicion. The victim in her statement before the police

Patna High Court CR. MISC. No.7883 of 2023(3) dt.24-06-2023 2/2 in paragraph 29 of case diary has denied the prosecution case. She in her statement u/s 164 Cr.P.C. also has not made any allegation of wrong doings against the petitioner. As per medical report, there was no sign of sexual assault and doctor has assessed her age as 18-20 years. Petitioner has got no criminal antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Purnea in connection with Dhamdaha PS case No. 52/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C.
