Petitioner is in custody in connection with Barahiya P.S. Case No. 99 of 2017 for the offence under section 366(A)/34 of the Indian Penal Code and section 8 of Protection of Children from Sexual Offence Act.
Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent. He submits that petitioner has no concern with the alleged incidence. Learned counsel for the petitioner further submit that petitioner was also among the family member who kidnapped the minor daughter of the informant.
Leaned counsel submits that having similar allegation other co-accused have been granted bail by a coordinate bench

Learned counsel appearing on behalf of the State submits that the name of this petitioner figures among the kidnappers and as such he does not deserve bail. Considering the fact that petitioner has no criminal antecedent, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, cum Spl. Judge, Lakhisarai, in connection with Barahiya P.S. Case No. 99 of 2017 in Pocso Case No. 21 of 2017 subject to the condition that both the bailors should be elected representatives of the local body.
