2. The petitioner apprehends his arrest in a case registered under Sections 304-B, 34, 201 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

3. As per prosecution case, informant solemnized the marriage of his sister with co-accused Bittu Kumar. After marriage, his sister was blessed with one child but during treatment child died. Thereafter, all the accused persons harassed informant's sister physically and mentally and demanded Rs. 5 lakh and one bike. It is further alleged that on 12.12.2022, all the F.I.R. named accused persons including this petitioner committed murder of informant's sister and disappeared her dead body.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been

Petitioner is victim of over implication. Petitioner is separate in mess and property and has never tortured the deceased nor demanded any dowry. Thrust of accusation is against husband of the deceased, who is already in custody. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State opposed the bail application.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I-cum-Additional Munsif-VI, Vaishali at Hajipur, in connection with Patepur P.S. Case No. 335 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
