Mr.Sanjay Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 Petitioners seek bail in connection with Ahiyapur P.S. Case No. 1505 of 2019, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 36 and 38 of the Bihar Prohibition and Excise Act. There is recovery of 36 and odd litres of liquor from Bolero vehicle and petitioners were arrested there. Submission of learned counsel for the petitioners is that they have been arrested only on suspicion and they are neither driver nor owner of the vehicle and they are in custody for one month, having no criminal antecedent. Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.5561 of 2020(2) dt.31-01-2020 2/2 petitioners be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 1505 of 2019, subject to the condition that he has to co-operate in the investigation and appear before police as and when required, otherwise his bail bonds shall be cancelled.
