The petitioner in the present case is seeking anticipatory bail in connection with Chakai P.S. Case No. 93/2019 registered for the offence under Sections 341, 323, 325, 384, 307, 379 and 34 of the Indian Penal Code pending before learned A.C.J.M. - III, Jamui.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. Learned counsel submits that the F.I.R. has been lodged with a delay of four days and petitioner has got no criminal antecedent.

Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.

No.5887 of 2020(2) dt.30-06-2020 2/2 Having regard to the facts and circumstances of the case and the allegation suggesting that the petitioner and other co-accused had brutally assaulted the informant, this petitioner had given blow by a Pliers (Pilas) on the mouth of the informant which fractured his three tooth, the allegation finding support from the injury report, I am not inclined to grant privilege of anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is, thus, refused.

In case, petitioner surrenders in the court below within a period of four weeks from today and pray for regular bail, his prayer for regular bail shall be considered on it's own merit without being prejudiced by the orders of this court.
