Mr.Pawan Kumar Chaurasia ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-06-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is apprehending arrest in connection with Keshariya P.S. Case No. 281 of 2019 for the offence under sections 457 and 380 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that nothing was recovered from the possession of the petitioner. He was not named in the FIR. His name has surfaced on the confessional statement of co-accused Vijay Kunwar where from certain stolen article was recovered.

Considering the fact that petitioner has not criminal antecedent, he was not named in the FIR and he belong to different village and also nothing was recovered from the

No.5509 of 2020(3) dt.30-06-2020 2/2 possession of the petitioner, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, in connection with Keshariya P.S. Case No. 281 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that on release the petitioner shall render his service as volunteer in dedicated Covid-19 hospital for a period of one month. He is required to report to the district Nodal Officer who shall utilize the service of the petitioner appropriately.
