JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 This is an application for grant of anticipatory bail in connection with Samastipur Mahila P.S. Case No. 48 of 2018, disclosing offences under Sections 341, 323, 498A, 34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Case is under Section 498-A of the IPC.

On appearance of the opposite party no. 2, the matter was referred to the Patna High Court Mediation & Reconciliation Center, vide order dated 23.04.2019. The report of Mediator is available on record at Flag "M" which disclosed that the dispute between the parties has been resolved on the terms of settlement mutually agreed upon between them, which is attached with the mediator's report. The memorandum of agreement disclosed that apart from other conditions there is an agreement that the petitioner shall pay

Patna High Court CR. MISC. No.8394 of 2019(4) dt.17-07-2019 2/2 Rs.2,50,000/- to the opposite party no.2 within a period of six months and also return the ornaments and other articles. Learned counsel for the petitioner and learned counsel for the opposite party no.2 have admitted the above facts. Having heard both sides, considering the above facts and circumstances, as stated above, let the petitioner, above named, appear before the learned court below on 29.07.2019 and on that day, the provisional bail granted to the petitioner, vide order dated 13.02.2019 shall be extended for a period of six months and during that period, once the total amount as agreed between the parties is deposited, his bail bonds shall be confirmed with the condition that both the parties will abide by the terms of agreement agreed upon them and at the same time, it is also expected that the opposite party no.2 shall also respect the terms and conditions of the agreement mentioned in the memorandum of agreement.

Let a copy of Mediator's report along with terms of agreement be sent to the court concerned for needful. With the aforesaid observations, this application is disposed of.
