JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2020 Petitioner seeks bail in connection with Bettiah Town P.S. Case No. 751 of 2019, registered for the offences punishable under Sections 413, 414/34 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act. Petitioner was arrested along with one motorcycle and he could not produce the paper and it is said that the motorcycle was stolen one.

Submission of learned counsel for the petitioner is that no case has been lodged with respect to theft of motorcycle and he is in custody since 15.10.2019, having no criminal antecedent.

Heard learned APP, who has opposed the prayer for bail.

Patna High Court CR. MISC. No.6156 of 2020(2) dt.04-02-2020 2/2 In view of above facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. However, once charge has been framed in this case or petitioner remains in custody for seven months, whichever is earlier, petitioner may renew his prayer for bail.

This application is, accordingly, dismissed.
