The petitioners seek bail in a case registered for the offences punishable under sections 307 and other allied sections of the Indian Penal Code.
Petitioner no. 1 Kanhaiya Mukhiya is alleged to have assaulted Tufani Mukhiya with Pharsa on his head. The injury found on the person of the informant is opined to be simple in nature. Petitioner no. 2 Paltu Mukhia is alleged to have assaulted Shankar Mukhia, father of the informant, with Pharsa. Shankar Mukhia got one sharp cut injury on his left side of head touching bone but no bone lesion was cut although the doctor has opined the injury to be grievous in nature. There is a counter
Patna High Court Cr.Misc. No.40220 of 2015 (2) dt.01-09-2015 version of the occurrence. The petitioners have already remained in jail for about two months.
Considering the facts aforesaid, the petitioners above named, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Yogapatti P.S. Case No. 333 of 2014.
