The instant application for regular bail has been filed by the petitioner in connection with Benipatti P.S. Case No. 67 of 2021 instituted for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 325, 326, 307, 302, 120(B) of the Indian Penal Code and Section 27 of Arms Act.

Earlier the application for regular bail of the petitioner was rejected by order dated 11.04.2023 passed in Cr. Misc. No. 29533 of 2022 with an observation to learned trial court to expedite the trial and conclude the same at the

Patna High Court CR. MISC. No.8411 of 2024(2) dt.16-02-2024 2/2 earliest.

It is submitted by learned counsel for the petitioner that vide order dated 09.02.2024, passed in Cr. Misc. No. 83956 of 2023, which arises from the same P.S. Case No. as that of the present case, learned trial court is directed to conclude the trial within 6 months, failing which, the petitioner will be at liberty to renew his prayer of bail. No fresh ground is made for reconsideration of the regular bail of the petitioner. Accordingly, prayer for grant of regular bail is rejected.

Accordingly, petition stands disposed off.

However, in pursuance to the submission made above, learned trial court is directed to conclude the trial within a period of 6 months, failing which, the petitioner will be at liberty to renew his prayer of bail.
