This is a petition for grant of anticipatory bail for offence under Section 427, 406, 379, 323 and 504 of the Indian Penal Code.
Allegation is that at persuasion of the petitioner the informant and others deposited money with the private financial institution of which the petitioner was an agent or Field Manager. The company failed and fled away with the money of the informant and others.
After hearing the parties and considering the nature of allegation, I am not inclined to enlarge the petitioner on anticipatory bail.
The prayer for anticipatory bail is refused.
However, in the event of surrender and
Patna High Court Cr.Misc. No.32762 of 2016 (4) dt.23-03-2017 2/2 production of any certificate of deposit of money by the petitioner in the same financial institution, the Court below shall consider the prayer for regular bail without being prejudiced by this order.
