The petitioner has preferred this application for grant of regular bail in a case registered under section 302 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, it is stated that accused Ravi Kumar @ Katori shot the brother of the informant in his head leading to his death.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. From perusal of the FIR it would be evident that the sole assailant of the deceased is accused Ravi Kumar @ Katori. The name of the petitioner transpired in the confessional statement of accused Amit Kumar

Patna High Court CR. MISC. No.17482 of 2021(3) dt.14-09-2021 2/2 who has been enlarged on bail vide order dated 8.2.2021 passed in Cr. Misc. no.40472 of 2020. Copies of the orders whereby a number of other accused have been enlarged on bail has been brought on record as annexures to the supplementary affidavit filed on behalf of the petitioner. The petitioner is in custody since 28.5.2020 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the petitioner is directed to be enlarged on bail in connection with Sessions Trial No. 297 of 2021 (arising out of Danapur P.S. Case no. 306 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge III, Danapur, district Patna.
