====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 14-10-2015 Heard Sri Ajay Kumar Pandey, learned counsel for the petitioner.

This is the second attempt for grant of bail on behalf of the petitioner, who is in custody in S.Tr. No.1347 of 2013, arising out of Hathidah P.S.Case no.01 of 2008 registered for the offence under Sections 302/201/34 of the Indian Penal Code. Earlier by order dated 16.09.2015 a report was called for regarding stage of the case, which has been received and kept at Flag-B. The report suggests that the trial has commenced and till date three witnesses have been examined and witness no.4 has been examined and his cross-examination is in continuation. Keeping in view the fact that since trial is continuing, there is no reason for extending the privilege of bail. The petition

Patna High Court Cr.Misc. No.43337 of 2015 (3) dt.14-10-2015 2/2 stands dismissed. However, while dismissing the present petition, it is necessary to observe that the learned trial court may take appropriate steps, so that the trial may come to its logical end without unnecessary delay.
