JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 The petitioner seeks regular bail in connection with Mairwa P.S. Case No. 249 of 2019, registered for offences punishable under Sections 25(1-b)a/26/35 of the Arms Act. Allegation is of recovery of country made pistol and cartridge. Apart from that he is accused in seven other cases. It has been submitted on behalf of the petitioner that there is dispute with respect to petrol pump and due to which, he has falsely been implicated in this case and so far this case is concerned, he has been in custody for more than five months and ready to abide by any condition imposed on him. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs.
Patna High Court CR. MISC. No.7681 of 2020(2) dt.18-02-2020 2/2 Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -VI, Siwan, in connection with Mairwa P.S. Case No. 249 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds with further subject to the condition that petitioner has to appear before the Officerin-Charge of the police station of his area in the first week of each month for a period of nine months so that the police may watch his activities during that period.
Let a copy of this order be communicated to the Superintendent of Police, Siwan for needful.
