JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-01-2016 Both the aforesaid petitions arise out of Dhamdaha P.S. Case No. 160/14 and, accordingly, the aforesaid petitions are being disposed of by this common order.

Petitioner in Cr. Misc. No. 44748/2015 is named in the First Information Report and petitioner in Cr. Misc. No. 48419/2015 is named in the Fardbeyan as son of petitioner in Cr.

Patna High Court Cr.Misc. No.44748 of 2015 (3) dt.29-01-2016 2/2 Misc. No. 44748/2015. There is accusation against the petitioners and other accused that they mercilessly assaulted the deceased by means of lathi but, in course of investigation, not a single witness claimed to have seen the actual occurrence. No doubt, the injuries were found on the person of the deceased but petitioner in Cr. Misc. No. 44748/2015 is father-in-law whereas petitioner in Cr. Misc. No. 48419/2015 is brother-in-law of the deceased and no specific overt act has been attributed against them. Accordingly, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Purnea in Sessions Trial No. 283/15, arising out of Dhamdaha P.S. Case No. 160/14.
