2. Heard learned counsel for the petitioner and learned APP for the State.
3. The petitioner is in custody in a case registered for the offence punishable under Sections 33, 34 and 36 of the Bihar Prohibition and Excise Act, 2016 & Bihar Prohibition and Excise (Amendment) Act, 2018.
4. As per the prosecution story, the police on secret information reached the house of one Ramswaroop Yadav and from a vacant land situated on the eastern side, six empty pouches of 200 ML recovered/seized.
5. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.20200 of 2024(6) dt.12-07-2024 2/2 petitioner has falsely been implicated in this case only on the basis of suspicion and petitioner is not named in the FIR. Petitioner is in custody since 27.02.2023. He next submits that similarly situated co-accused persons have already been granted bail by Co-ordinate Benches of this Court passed in Cr. Misc. Nos.13094 of 2023, 13889 of 2023, 11797 of 2023, 72878 of 2023, 72615 of 2023, 72316 of 2023 and 73866 of 2023 respectively.
6. Learned APP for the State opposes the prayer for bail of the petitioner.
7. Considering the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-I, Nawada in connection with Nawada (Nagar) P.S. Case No. 387 of 2021.
