JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-12-2016 The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is languishing in custody since 02.08.2013.

The prosecution case is that the petitioner killed his father for partition of the property since the father of the petitioner has performed two marriages.

It is submitted by Mr. J.N. Thakur, learned A.P.P that out of 13 witnesses, 10 witnesses have already been examined and rest 3 witnesses will be examined very shortly. Considering the advanced stage of the trial, this Court is not inclined to interfere.

It is expected from the Superintendent of

Patna High Court Cr.Misc. No.42527 of 2015 (4) dt.21-12-2016 2/2 Police, Vaishali at Hajipur to produce rest of the witnesses expeditiously.

It is expected from learned Sessions Judge, Vaishali at Hajipur to conclude the Sessions Trial No. 376 of 2015, arising out of Mahua P.S. Case No. 319 of 2012 expeditiously and transmit a report to this Court on conclusion of the trial.

With the observations above, the application stands disposed of.
