2. The petitioner seeks bail in connection with NDPS G.R. Case No. 74 of 2024 arising out of Raxaul P.S. Case No. 332 of 2024 registered for the offence punishable under Sections 8/20 (b) II (C)/25 & 29 of the NDPS Act.
3. The following statement has been made in paragraphs No. 12 and 13 of the bail petition:- "That the aforesaid Informant namely Sanjivan Paswan Sub- inspector of Poilce just few days after lodging of the present frivolous FIR was caught red handed by the State Vigilance taking illegal gratification and consequently, Vigilance P.S. Case No. 09/24 dated 18.09.2024 has been lodged against him on taking him in custody. The same was also widely reported in all the newspapers.
13. That in reality the Informant with his team raided one Hotel Shyam International situated at Koriya Tola, Main Road, Raxaul on 14.09.2024 wherein Petitioner
Patna High Court CR. MISC. No.10058 of 2025(2) dt.06-03-2025 2/2 was also present and he was forcibly apprehended by the Informant and was thrown into a white color Bolero Police Vehicle precisely at 05:05:37 PM with two other persons as the Petitioner refused to be a witness and signed blank papers against the dictate of the Informant. The clear CCTV footage of the same was procured and duly submitted before the Ld. Court Below in a pen drive annexing it with the Bail Petition dated 19.10.2024 but the same was not at all considered or dealt by the Ld. Court Below while rejecting the Petitioner's Bail application. The Petitioner craves the leave of the Hon'ble Court to produce the said CCTV footage of the petitioner's arrest at the time of hearing of the present case."
4. From the above, it appears that the submission of the petitioner is that he has been falsely implicated by the A.S.I. who has himself been arrested while accepting bribe.
5. The petitioner is a school teacher and it is not expected that he will involve in such kind of crime. He is in jail since 15.09.2024 and he claims to have clean antecedent.
6. Considering the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Session Judge cum Special Judge, East Champaran/concerned court in connection with Raxaul P.S. Case No. 332 of 2024.
