2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 109, 3(5) of the B.N.S. and u/s 25(1-B)(a), 26, 27 and 35 of the Arms Act.
3. The prosecution case in brief is that on 21.07.2024 at around 6:00 P.M. while the informant was at his residence, at around 7:37 P.M. some unknown criminals riding on a motorcycle approached and opened fire on him. It is further alleged that he was previously extorted for a sum of Rs. 1 Crore. Due to this incidence, informant and his family members are living in fear.
4. Learned counsel for the petitioner submit that the petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the F.I.R. and his name has
Patna High Court CR. MISC. No.6654 of 2025(3) dt.20-03-2025 2/2 surfaced on the basis of confessional statement of co-accused. There is no any other material against the petitioner except the confessional statement to show his complicity in the crime.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submit that petitioner was involved in the alleged crime and he bears two criminal antecedents also.
6. Considering the aforesaid facts of the case and also criminal antecedents of the petitioner, this anticipatory bail petition stands rejected.
