JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 The petitioner seeks regular bail in connection with G.O. Case No. 05 of 2020 arising out of Sadar P.S. Case No. 545 of 2019, registered for offences punishable under Section 37 (b) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of more than 120 litres from the field of the school and two persons were arrested, who disclosed the name of petitioner. Apart from that it appears that petitioner is accused in three more cases.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and nothing has been recovered from the petitioner and though, he is accused in the three other cases but that is not under Excise Act. Further submission is that he has been in judicial custody since

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge-cum-Special Judge (Excise Act), Darbhanga, in connection with G.O.
