JUSTICE SHIVAJI PANDEY ORAL ORDER 07-04-2021 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. In this case, the petitioner is seeking regular bail in connection with Special Case No. 4 of 2020, arising out of Vigilance P.S. Case No. 2 of 2020 registered for offence under section 7 (a) of the Prevention of Corruption Act, 1988. The petitioner was caught red handed while taking Rs.9,000/- as bribe which led to institution of the case. Earlier the petitioner had moved before this Court for grant of regular bail in Cr. Misc. No.20929 of 2020 and this Court, vide order dated 04.09.2020, rejected the same with liberty to renew his prayer for bail after completion of one year of judicial custody.

Looking to the period of custody, let the petitioner above named be released on regular bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Special Judge (Vigilance) North Bihar, Muzaffarpur in connection with Special Case No. 4 of 2020, arising out of Vigilance P.S. Case No. 2 of 2020, subject to the condition that one of the bailors of the petitioner shall be his close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. In case of failure on two consecutive dates without any valid reason, the court below will have liberty to pass any order even cancellation of the bail of the petitioner.
