The petitioner seeks bail in a case registered for the offences punishable under sections 395 of the Indian Penal Code.

Petitioner is not named in the F.I.R. Nothing has been recovered from possession of the petitioner. Name of the petitioner figured in the case in the confessional statement of Sanjay Pandit. Later on Baby Kumari gave her statement under sections 164 Cr. P.C. She also disclosed the name of the petitioner as the person who had threatened her to face with dire consequences but no tangible material has been collected by the police during investigation.

Considering the facts aforesaid, the petitioner

Patna High Court Cr.Misc. No.42884 of 2015 (2) dt.17-09-2015 above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Jamui in connection with Jhajha P.S. Case no. 85 of 2015.
