====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek bail in a case registered for the offences punishable under Sections 302, 120 (B), 498(A) and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are in custody since 30.08.2022 and are persons with clean antecedent and are mother-in-law and father-in-law of the deceased. The learned counsel next submits that the daughter of the informant was married with the son of the petitioner in the year 2012 and after marriage it is alleged that the deceased was being tortured for non-fulfillment of dowry demand of Rs.

Patna High Court CR. MISC. No.7951 of 2023(2) dt.29-04-2023 2/2 2,00,000/-. The learned counsel next submits that from perusal of the allegation as alleged in the FIR it would manifest that no specific allegation has been alleged against the petitioner nor the informant is an eye witness to the occurrence, it is next submitted that whenever such dispute arises the entire family members are implicated.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody since 30.08.2022 and charge-sheet has been submitted in the case and the petitioners are persons with clean antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Azamnagar (Salmari O.P.) P.S. Case No. 226 of 2022.
