JUSTICE RAMESH KUMAR DATTA ORAL ORDER 17-10-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has approached this Court for quashing the letter dated 6.12.2012 issued by the Engineer-in-Chief, Rural Works Department, Government of Bihar by which the petitioner has been declared defaulter and debarred from participating in future tenders of the State.

Nothing has been shown by learned counsel for the petitioner to justify the petitioner's approaching this Court after more than three and a half years against the order of debarment. The writ application is, thus, dismissed on the ground of delay and laches.

However, it shall be open to the petitioner to take recourse to appropriate remedy before appropriate forum, as may be advised in accordance with law.
