The petitioner seeks bail in a case registered for the offences punishable under sections 302, 120(B), 379 of the Indian Penal Code and section 27 of the Arms Act. The petitioner is not named in the F.I.R. One Binod Pandit identified two persons, namely, Bhutush Yadav and Bambam @ Ganesh Yadav and stated that both dragged the deceased from auto rickshaw and three persons fired at him. The deceased was seriously injured. The accused persons fled away with the bag of the injured. Vicky Yadav and Ram Manjhi also identified Bhutush Yadav and Bambam @ Ganersh Yadav. Ram Manjhi and Vicky Yadav also identified the petitioner as the person standing on the spot. The petitioner was apprehended and
Patna High Court Cr.Misc. No.40242 of 2015 (2) dt.01-09-2015 he is said to have confessed his guilt. Bhutush Yadav and Ganesh Yadav have already been enlarged on bail. The case of the petitioner stands on better footing as that of the two accused persons. The petitioner was only seen standing at the place of occurrence.
Considering the facts aforesaid, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Munger in connection with Naya Ram Nagar (Safiasarai) P.S. Case No. 162 of 2012, corresponding to Sessions Trial No. 79 of 2015.
