The petitioner seeks bail in a case under Section 395, 364A of the Indian Penal Code.
The petitioner is not named in the FIR. The name of the petitioner figured in the case in the confessional statement of co-accused. The victim was also recovered and made his statement under 164 of the Cr.P.C. but he did not disclose the name of petitioner. Save and except confessional statement of coaccused the police did not collect any further evidence. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Paraiya P.S.
