After some argument, learned Counsel for the petitioner seeks permission to withdraw this application with liberty to make appropriate application, in the Court of learned Additional Chief Judicial Magistrate, Nawada, claiming discharge of the petitioner, who is an accused, in Nawada Mufassil P.S. Case No.67 of 2006, on the ground that no incriminating material has been collected by the Investigating Agency in order to sustain the accusations made in the police report, which has been submitted, under Section 173(3) Cr.P.C., and also take recourse to such provisions of law as may be
