JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-09-2015 Counter affidavit is filed on behalf of the victim Sindhu Kumari, who appeared in person before this Court. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 24.07.2015 in a case registered under section 366A/34 of the Indian Penal Code. The accusation against the petitioner is that he had kidnapped the informant's minor daughter, namely, Sindhu Kumari.

The victim namely, Sindhu Kumari, stated before this Court that she has solemnized her marriage with the petitioner on her own sweet will. She discloses her age as 19 years and further states that presently she is residing with the parents of the

Although the statement of victim has not been recorded under section 164 of the Cr.P.C but taking note of the aforesaid facts and circumstances as well as submissions of the parties and particularly keeping in mind the statement of victim before this Court, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Saran at Chapra in connection with Marhowrah P.S.Case No. 219 of 2015.
