Ms. Veena Rani Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 01-08-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest in Madanpur P.S. Case No.289 of 2021, registered for the offences punishable under Sections 420, 406, 409 and 120(B) of the Indian Penal Code. Allegation is of embezzling the amount withdrawn by the Chairman of Ward Management and Implementation Committee of Ward No.9 of Gram Panchayat Erki Kala, namely, Arun Kumar Singh and Secretary Ravi Ranjan Kumar for the purpose of constructing drainage and PCC.

Learned counsel for the petitioner submits that the petitioner is ready to deposit Rs.2,71,379/- in the account of the concerned Panchayat in two installments. The first installment of Rs.1,00,000/- shall be paid at the time of furnishing bail bond and the rest amount shall be paid after three months from the date of

Taking into consideration the submissions of the learned counsel for the petitioner, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on provisional anticipatory bail for a period of four months on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Madanpur P.S. Case No.289 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. The learned court below is directed to accept the bail bond of the petitioner after verifying the fact that the petitioner has deposited Rs.1,00,000/- in the account of the concerned Panchayat.

After four months, if the learned court below finds that the rest amount, i.e., Rs.1,71,379/- has also been deposited in the account of the concerned Panchayat, the bail bond of the petitioner shall be confirmed by the learned court below. (Anjani Kumar Sharan, J.)
