Priyanka Raj v. The State Of Bihar And ORS
IN THE HIGH COURT OF JUDICATURE AT PATNA
Civil Writ Jurisdiction Case No.5192 of 2018 ====================================================== Priyanka Raj ... ... Petitioner/s
Versus
The State Of Bihar & Ors ... ... Respondent/s ====================================================== Appearance :
For the Petitioner/s :
Mr. Dr. Anjani Pd. Singh For the Respondent/s :
Mr. Madanjeet Kumar -GP 20 ====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-04-2018 Earlier, the petitioner had approached this Court by filing writ application, seeking the same relief, giving rise to CWJC No. 12735 of 2017. The writ application was disposed of by an order, dated 06.12.2017, which reads thus:- "Learned counsel for the Bihar School Examination Board has produced the answer-sheet of the chemistry of the petitioner before this Court.
The petitioner is present in Court and she does not dispute that it is not her answer-sheet.
Learned counsel for the petitioner has, however, submitted that the examiner has awarded zero marks even for the correct answers.
The Court cannot go into such aspect of the matter.
Patna High Court CWJC No.5192 of 2018(2) dt.03-04-2018 2/2 On perusal of the answer-sheet, it appears that each and every answer has been evaluated and there is no mistake in totaling of the marks awarded to her.
This application has no merit and accordingly, it is dismissed.
Let the original answer-sheet be returned to learned counsel for the Bihar School Examination Board."
The petitioner's case was, thus, decided on merits. Filing of the second writ application seeking same relief is wholly unjustified and ill-advised.
This application is accordingly dismissed as not maintainable.
