In this case, the petitioner is seeking anticipatory bail in connection with Jagdishpur P.S. Case No. 342 of 2018, registered for the offence under Sections 409 and 420 of the Indian Penal Code.
The petitioner was the Headmistress of Guraj Primary School, she was given Rs.6,30,000/- for construction of the building of the school. Allegation has been made that she has only completed the work upto the amount of Rs. 4,50,431/- and whereafter the petitioner closed the work and did not complete the same.
Learned counsel for the petitioner submits that the petitioner has completed the construction of the building,
Patna High Court CR. MISC. No.11019 of 2019(2) dt.26-02-2019 2/2 inasmuch as, she from her own pocket has invested Rs.2,00,000/- in the construction of the building of the school and that money she has not received from the Government. In view of the above statement made at Bar, let the petitioner, namely, Lal Munni Kumari @ Lakhmunni Kumari, be released on anticipatory bail in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-XI, Bhojpur at Ara, in connection with Jagdishpur P.S. Case no. 342 of 2018 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
