JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is languishing in jail custody since 0804-2015 on the accusation that one loaded country-made Katta was recovered from his conscious possession, when he alongwith others had assembled for committing dacoity. Though petitioner carries criminal antecedent but having more or less similar allegation, one co-accused namely, Mithilesh Rai has already been granted privilege of bail by a coordinate bench of this court. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bajpatti P.S. Case No. 49 of 2015 to the satisfaction of Chief Judicial Magistrate, Sitamarhi.
