In this case, the petitioner is seeking anticipatory bail in connection with Chakai P.S. Case No.164 of 2018, registered for the offence punishable under Sections 379 and 406 of the Indian Penal Code and Section 7 of Essential Commodities Act. Allegation has been made that about 180 KG of Arwa rice meant for PDS was recovered from the auto belonging to the petitioner, which belongs to co-accused Gopal Mandal, however, counsel for the petitioner submits that he was no knowledge or any information that a passenger, namely, Gopal Mandal, was carrying any rice meant for PDS for the purpose of black marketing.

Looking to the entire facts and circumstances of the

No.5459 of 2020(2) dt.02-03-2020 2/2 case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in connection with Chakai P.S. Case No. 164 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
