JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report with accusation that he along with other FIR named accused persons went to the house of informant and made indiscriminate firing causing death of the informant's nephew but in course of investigation, the witnesses stated that it was co-accused, Tribhuvan Tiwary, who shot the deceased dead and so far as petitioner is concerned; it is only stated that he was also a member of unlawful assembly. The petitioner does not have any criminal antecedent and the investigation against him has already been completed and, therefore, further detention of the petitioner is not needed.
Patna High Court Cr.Misc. No.41473 of 2015 (2) dt.15-09-2015 Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mairwa P.S. Case No. 65 of 2015 to the satisfaction of Chief Judicial Magistrate, Siwan.
