1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Ramnagar Police Station Case No. 458 of 2024, dated 01.10.2024, disclosing offences punishable under Sections 126(2)/115 (2)/118(2)/109 (1)/351(2)/352/3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. The prosecution case, as per the First Information Report, is that on 05.09.2024, at about 12:15 PM, while the informant's son was returning after attending nature's call, two unknown persons caught him and the petitioner told his son to kill the son of the informant, upon which
Patna High Court CR. MISC. No.8714 of 2025(3) dt.14-05-2025 2/3 the son of the petitioner inflicted knife blow in the stomach of the son of the informant, due to which he was badly injured.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to previous enmity, which would be evident from the First Information Report itself. He further submits that there is no allegation of assault against the peitioner; rather, he has been described as order giver. Both parties are neighbour.
5. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that both the parties are neighbour, there is previous dispute between the parties, the petitioner is order giver, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub
