The petitioner is languishing in jail since 23.09.2014 in a case instituted under Sections 498 (A), 307 and 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. As per allegation, it is a case of torture in order to kill the informant by the husband and in-laws.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.09.2014. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner has got no criminal antecedent. Petitioner is falsely implicated in the present case. There is no direct evidence against the petitioner.

Patna High Court Cr.Misc. No.41022 of 2015 (3) dt.14-10-2015 On behalf of the State, it has been submitted that the petitioner is the husband of the informant.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bhagalpur in connection with Sajour (Shahkund) P.S.Case No.153 of 2014.
