====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 08-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Pirpainty P.S. Case. No. 69 of 2018, instituted for the offence under Section(s) 384, 386 and 379/34 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report.

It is alleged in the written report that three unknown persons surrounded the informant with Motorcycle bearing registration No. JH18D-5710 and assaulted him. They at the point of gun, made demand of Rs.1,000/-from the informant. They also snatched Rs.24,743/- from him.

The Sessions Judge has mentioned in the impugned order that aforesaid Motorcycle No. JH18D-5710 has been

Patna High Court Cr.Misc. No.7526 of 2019(2) dt.08-02-2019 2/2 recovered from house of the petitioner.

Counsel for the petitioner submits that No Test Identification Parade has been held. Neither there is any recovery of Motorcycle nor any money from conscious possession of the petitioner.

Petitioner is in custody since 30.7.2018, having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Bhagalpur, in connection with Pirpainty P.S.
