JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-04-2023 Though the present writ petition has been filed to remove encroachment from the public road situated at western side of Plot No. 1838 and 1841 (old), Khata No. 381, situated under Babu Barhi Circle, however, it is submitted by the learned counsel for the respondent-State that an encroachment proceeding vide Encroachment Case No. 10 of 2014-15, has already been initiated against the encroachers.
In view of the aforesaid, I deem it fit and proper to direct the Circle Officer, Babu Barhi,
Patna High Court CWJC No.12108 of 2017(2) dt.21-04-2023 2/2 District- Madhubani, to dispose off the aforesaid encroachment proceeding, if not already disposed off, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in accordance with law and after hearing the affected parties, within a period of six weeks from today. The writ petition stands disposed off on the aforesaid terms.
