The petitioner seeks bail in connection with Bidupur P.S. Case No. 317 of 2021 instituted for the offences under Sections 30(a) and 41(i) of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 27.11.2021, charge-sheet has been submitted in the case and has antecedent of three cases. Learned counsel for the petitioner submits that the allegation is of recovery of 1830 litres of liquor from a pickup van.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name came on information received by the police that he is a dealer.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise, Vaishali at Hajipur in connection with Bidupur P.S.
