====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-05-2023 Heard learned counsels for the petitioner and the State.
Petitioner apprehends arrest in case registered for the offence punishable under Section 392 of the Indian Penal Code. As per prosecution case, on 12.07.2022 at about 7:30 P.M. informant along with his friends proceeded for Mahuli petrol pump on two motorcycles to purchase diesel. It is alleged that when they reached near Bichli Ahar, four persons including the petitioner intercepted the motorcycles and on the point of pistol, they snatched a gold chain from the possession of the informant and Rs. 5500/- cash from the possession of Golu Kumar. It is further alleged that the informant raised alarm and the villagers chased the alleged culprits and two of them were caught at the spot and thereafter, the informant immediately
Patna High Court CR. MISC. No.8193 of 2023(2) dt.12-05-2023 2/2 informed the Police and handed them over to the Police. Learned counsel for the petitioner submits that though there is allegation of loot on the point of pistol but no pistol has been recovered from the spot and this itself falsifies the entire prosecution case. Informant and petitioner are co-villagers and out of personal grudge, this false and concocted case has been made against the petitioner.
However, learned counsel for the State opposes the prayer for bail and submits that petitioner is named in the F.I.R. and is alleged to have committed loot on the point of pistol. Considering the nature of allegation, prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Navya/- U T
