Perused the impugned order dated 05.05.2016 passed by Subordinate Judge-IX, Motihari in Title Suit No.105 of 1992. From perusal of the impugned order, it appears that the court below has passed the order after considering the relevant provisions of the Code of Civil Procedure and assigning good reasons has rejected the application filed by the petitioner under Section 10 of the Code of Civil Procedure. Therefore, there is no question of jurisdictional error or that it occasioned failure of justice nor it prejudiced the petitioner arises. Therefore, it is not a case for interference in exercise of supervisory jurisdiction. Accordingly, this civil miscellaneous application is dismissed. Harish/- (Mungeshwar Sahoo, J) U
