====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 18-09-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Though the notice was validly served upon the opposite party no.2, but nobody has entered appearance on her behalf.

3. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 354B and 504 of the Indian Penal Code.

4. The allegation against the petitioner is said to have established physical relations with the informant several times on the pretext of marriage due to which she got pregnant twice but at the end, this petitioner has solemnized the marriage with

5. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is a government servant and is posted as Constable in Bihar Police. No such occurrence as alleged ever took place. He has been falsely implicated in this case due to dirty village politics. The allegation levelled against the petitioner is totally false and based on concocted facts. It is further submitted that the cognizance has also been taken under Section 323, 354-B and 504 of the Indian Penal Code against the petitioner. Petitioner has no criminal antecedent as mentioned in para-3 of this application.

6. Learned APP for the State opposes the prayer for bail.

7. Having regard to the facts and circumstances of the case, as the cognizance has been taken under Section 323, 354B and 504 of the Indian Penal Code against the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection
