JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 399, 402, 400 of the Indian Penal Code and 25(1-b)a, 26, 35 of the Arms Act. As per the prosecution case, police acting on a secret information that some accused persons are conspiring to commit some offence, raided a place. It is alleged that 5 accused persons managed to escape, whereas one of them apprehended who disclosed the name of the petitioner.
Learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner nor he was present on the place of occurrence. Name of the petitioner surfaced in the case by one of the co-accused
Patna High Court CR. MISC. No.7604 of 2023(2) dt.24-04-2023 2/2 Arvind Ram and no case u/s 399, 402, 400 IPC and 25(1-b)a, 26, 35 of the Arms Act is made out against the petitioner. Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Gopalganj in connection with Gopalganj (Town) P.S. case no726 of 2020 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
