Petitioner, who is in custody, seeks bail in connection with Special Case No. 60 of 2018, arising out of Gandhi Maidan P.S. Case No. 231 of 2018 registered for the offences punishable under Sections 399, 402 of the Indian Penal Code, Section 25(1-B) A, 26, 35 of Arms Act and Section 27 NDPS Act.

Allegation is recovery of one country made pistol loaded with one live cartridge and a pudia of Ganja from the possession of the petitioner. Petitioner has criminal antecedent. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been

Patna High Court Cr.Misc. No.6594 of 2019(2) dt.14-02-2019 2/2 falsely implicated in this case. Petitioner is in custody since 10.06.2018.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.

However, after completing one year of the custody, the petitioner would be at liberty to renew his prayer for grant of bail.
