Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-04-2022 Heard Mr. Anil Kumar Saxena, learned Advocate for the petitioner and the learned APP.

The petitioners seek bail in anticipation of their arrest in connection with Khizarsari P.S. Case No. 78 of 2020 dated 12.03.2020 instituted for the offences under Sections 341, 323, 325, 307, 379, 427, 498 and 34 of the Indian Penal Code. Though the petitioners are said to have assaulted two different persons but both the victims have received only simple injuries.

Learned counsel for the petitioners has submitted that the accusation is absolutely false and they have been made accused only with evil intention. The petitioners and the

Patna High Court CR. MISC. No.18277 of 2021(3) dt.28-04-2022 2/2 informant are at logger-heads with each other with respect to some property over which both sides have been staking their claims.

Regard being had to the fact that the injuries suffered by the two victims have been reported to be simple in nature, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Gaya in connection with Khizarsari P.S. Case No. 78 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
