2. The petitioner seeks bail in a case registered for the offence punishable under Sections-317(4), 317(5), 3(5) of the Bhartiya Nyay Sanhita and Sections-25(1-B)(a), 26/35 of the Arms Act.

3. It is alleged that in course of vehicle checking, the petitioner along with one another was apprehended with a motorcycle and on search, a country-made pistol with live cartridges was recovered from the motorcycle.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. The petitioner has been made accused in the present

Patna High Court CR. MISC. No.6181 of 2025(2) dt.19-02-2025 2/2 case merely because he was a pillion rider on the motorcycle, in question. The petitioner is in custody since 05-11-2024.

5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 396 of 2024.

7. Before accepting the bail bonds, the criminal antecedent of the petitioner shall be verified and if, it is found that he is involved in any other case except the case(s), mentioned in paragraph-3 of the bail petition, his bail bonds shall not be accepted.
