Petitioner is an accused in connection with Masaurhi P.S. Case No. 663 of 2019 for the offence registered under Sections 341, 342, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in connection with the present case due to old grudge. It is further submitted that the petitioner was sleeping in his house on the alleged date of occurrence in fact, he had no knowledge about the occurrence. Learned A.P.P. appearing on behalf of the State, on perusal of the first information report, submits that the petitioner was carrying pistol in his hand and opened fire upon the brother

Patna High Court CR. MISC. No.10337 of 2020(3) dt.04-03-2020 2/2 of the informant which caused injury on the right leg. The witnesses have also supported the prosecution case. As such, the petitioner is not entitled to the privilege of regular bail. Having considering the entire facts and circumstances of the case and the nature of allegation, this Court is not inclined to allow the prayer for bail of the petitioner.
