====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 20-02-2024 Heard Mr. Ravi Prakash, learned counsel appearing on behalf of the petitioner and Mr. Ajay Mishra, learned Spl.PP for the State.

2. The petitioner seeks pre-arrest bail in connection with Benipatti P.S. Case No. 37 of 2023 registered for the offence punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

3. As per the allegation made in the F.I.R. the petitioner got appointment on the post of Panchayat teacher on the basis of forged and fabricated documents.

4. Learned counsel appearing on behalf of the petitioner submits that he has made specific statement in Para13 of the bail application that the petitioner has been terminated from service on 16.03.2023 vide Letter No. 498. Petitioner has

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the aforesaid facts, the District Court is directed to verify as to whether the petitioner has been terminated from service and if the petitioner files an affidavit to the effect that she has been terminated from service and in support of the same she produces the document / evidence duly issued by the competent authority, then in that case, the petitioner is directed to be released on pre-arrest bail, in the event of her arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Madhubani in connection with Benipatti P.S. Case No. 37 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Purnendu Singh, J) mantreshwar/- U T
