====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Special Excise Case No. 2159 of 2019 arising out of Rail Gaya P.S. Case No. 433 of 2019 for the offenses under Sections 30(a) and 30(d) of the Bihar Prohibition & Excise Act, 2018. Learned counsel for the petitioner submits that the petitioner has got a clean antecedent. In the instant case total 20.800 ltrs of foreign liquor was seized. Learned counsel for the petitioner further submits that nothing was recovered from the conscious possession of the petitioner. The petitioner is in custody since 12.12.2019.

Considering the fact that the petitioner has got a clean antecedent, the Court is inclined to grant bail to the petitioner.

No.5327 of 2020(2) dt.31-01-2020 2/2 Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Gaya, in connection with Special Excise Case No. 2159 of 2019 arising out of Gaya P.S. Case No. 433 of 2019.
